Danish national man given deferred prison term for sharing nude film clips on the social platform Reddit

A Danish citizen has been found guilty of sharing sexually explicit scenes from copyrighted films and television shows on the social media platform Reddit.

Based on a law enforcement report obtained by media outlets, the anonymous man posted 347 video excerpts of nude content in a Reddit group he moderated, which were then viewed 4.2 million-plus times.

Danish authorities state he has been handed a 7-month suspended sentence for copyright infringement.

Legal analysts say the defendant was charged under a seldom-invoked clause in Denmark's intellectual property legislation, with the court ruling that by removing the footage out of their original context, the man had damaged the artists' "moral rights".

He has additionally been convicted of sharing more than 25 terabytes of protected data.

From spring 2022 to May 2023, the man known as "the pseudonym KlammereFyr" on Reddit posted sexually explicit scenes including over 100 actresses.

He shared them in the subreddit he was a administrator of.

Per the Denmark's anti-piracy organization the Rights Alliance, his online community had more than 6,000 subscribers and participants were encouraged to request excerpts of specific performers.

In last year, advocates reported the incident to the police on behalf of the affected artists, directors and production companies, which led to the forum being shut down.

Andrea Vagn Jensen, one of the actresses whose nude scenes were circulated in the group, explained to local media at the time she believed there was a distinction between appearing naked in a movie and appearing on Reddit.

The actress stated the uploads amounted to "exploitation".

The defendant was detained in fall 2024 and admitted guilty to the allegations recently.

In a comment following the ruling, TRA head Maria Fredenslund remarked the outcome sent an "significant" signal "indicating violations of creators' rights have consequences".

The verdict is considered unique in the country for its use of the "moral rights" clause of the national copyright law, which states an creator's work cannot be utilized in a manner which infringes upon their reputation.

Copyright law expert Dr Alina Trapova informed the media the case was "rare" for its emphasis on the damage to the integrity of an performer, rather than to them economically.

The extent to which the ruling could influence other countries is uncertain.

But she said there may be "an increasing number of such cases" in the future with the growth of AI, where "the integrity of an individual's work might be compromised much more easily".
